1. Falk Content & Internet Solutions GmbH & Co. KG takes the protection of your personal data very serious and strictly observes the provisions of the Federal Data Protection Act. The following declaration provides you with an overview of how Falk Content & Internet Solutions GmbH & Co. KG guarantees this protection and what type of data are collected for what purposes.
2. Falk Content & Internet Solutions GmbH & Co. KG automatically collects and saves information in its server log files which are sent to us by your browser. These are:

2.3 referring URL (last page visited)
2.4 accessed URL
2.5 data accessed
2.6 your computer's host name (IP address)

Falk General Terms & Conditions

1. Scope
1.1. The following Conditions of Use apply to the contractual relationship between Falk Content & Internet Solutions GmbH & Co. KG, Marco-Polo-Str.1, 73760 Ostfildern, Germany (hereinafter "FMI") and the User of the internet services offered by FMI on the domain www.gofalk.com. Through the use of these pages and services from FMI, the User accepts the Conditions of Use. If the User does not accept the conditions specified here he may not use www.gofalk.com or must immediately discontinue use of www.gofalk.com. A violation of the conditions specified herein by the User will lead to his immediate exclusion from use of these services. Such an exclusion can be permanent.
1.2. The Conditions of Use do not apply to products and services which FMI makes available to partners either free of charge or for payment, or which it has developed at their instruction. In this instance the Falk Content & Internet Solutions GmbH & Co. KG General Terms & Conditions for Route and Map Services shall apply.

2. Description of Services
FMI's main service is to provide the User with services in the area of "mobility and travel".

3. Rules
The User is fully responsible for all actions he undertakes while using the services. The following list includes, but is not limited to, actions which may lead to FMI terminating the agreement with a User who commits them:
3.1. The insulting, harassment, threatening or financial, physical or mental harm, abuse or endangering of another user or some other natural or legal person or entity via www.gofalk.com.
3.2. The collation or distribution via www.gofalk.com of any kind of information, data, text, files, links, programmes or other materials, in short, content, which FMI deems to be unlawful, harmful, extortionate, insulting, libellous, obscene, inflammatory, racist or objectionable in some other way.
3.3. The unsolicited sending of any kind of advertising material to www.gofalk.com users or any other type of advertising directed at www.gofalk.com users from www.gofalk.com. The sole exception to this are the elements of the service specifically designed for this purpose and explicitly designated as such.
3.4. The deliberate or unintentional violation of regional, national or international law; this shall also apply to all types of regulation of a legislative character which shall prevail during or in connection with the use of www.gofalk.com.

4. Client's input
4.1. The Client in particular undertakes to refrain from violating prevailing legal requirements when using the services of www.gofalk.com.
4.2. FMI advises that content saved through the services is on principle not inspected, or only within the scope of prevailing legislation.
4.3. FMI is entitled to pass on content to third parties or delete it where this is required under law, court injunction or official ordinance. FMI is further entitled to delete content where it violates the provisions of Art. 3 above.
4.4. The User indemnifies FMI for any claims by third parties which may be asserted against FMI because of the violation of the rights of third parties by the User or because of content which is unlawful or in breach of this agreement.

5. Provision of Services
FMI will endeavour to ensure that the services are provided to the users without interruption. Maintenance work and/or further development of the services may limit use and/or services may be temporarily unavailable. This may lead to the loss of the Client's data. FMI is at all times entitled to reduce the scope of the services.

6. Client's Obligations
The User undertakes to use all content on www.gofalk.com strictly for his own personal use.

7. FMI Input
FMI gives no guarantee for the correctness or completeness of FMI's input.

8. Data Protection
Conditions with regard to data protection are defined in the www.gofalk.com Data Protection Declaration.

9. Guarantee
The use of www.gofalk.com is at the User's own risk. FMI gives neither explicit nor implicit guarantees of any kind. This includes FMI's implicit suitability for use for economic or other purposes. FMI does not guarantee that www.gofalk.com will satisfy the User, that www.gofalk.com will be available at all times, will observe certain deadlines, is secure or without error. FMI gives no guarantee with regard to the benefit the User shall enjoy from the use of www.gofalk.com.
FMI also does not guarantee the correctness or reliability of information obtained through www.gofalk.com. Additional oral or written information received from FMI does not represent a guarantee or undertaking unless explicitly defined as such. The User declares that content which he has downloaded from www.gofalk.com or obtained by some other means through www.gofalk.com will be used exclusively on his own or other computer systems at his own responsibility and that he shall therefore bear the entire risk of such use and any resulting damage incurred. Such damage shall, in particular, be data loss or some other damage to the respective computer system.

10. Limit to Liability
FMI shall not be liable for losses incurred in connection with the services provided on www.gofalk.com.

11. Agreements on Goods or Services
Where goods or services are offered through www.gofalk.com, any contracts thus created exist solely between the Client and the tenderer of such goods or services.

12. Partial Invalidity
Where individual provision of this agreement are or become invalid under prevailing law, such provision shall be replaced by a valid wording which as closely fulfils the intention of the original wording. The validity of this agreement as a whole shall remain unaffected.

13. Miscellaneous
It is requested that the User read these rules and regulations from time to time to keep himself up to date with any amendments which may be made.

14. Alteration of the Conditions of Use
14.1. FMI reserves the right to amend the Conditions of Use where such amendments to the Conditions of Use, bearing the interests of www.gofalk.com in mind, may reasonably be accepted by the Client.
14.2. Where the Client does not accept the amendment of the Conditions of Use, he shall have the right to terminate this agreement without notice at any time. The alteration of the Conditions of Use for the use of FMI's services shall be deemed accepted where the Client continues to use the service one month after the amendment has taken effect.
14.3. The Conditions of Use and their amendments may be inspected at www.gofalk.com.

The aerial photographic material used on the website comes from the Digitale Luftbildkarte DLK and is the property of GeoContent GmbH. Through its respective partners and service providers, GeoContent grants the User a non-transferable, non-exclusive right to use the image material for private, non-commercial purposes. The aerial photographic material may be saved, copied and printed solely for private purposes.

The use of the aerial photographic material by public bodies and non-profit organisations, by service agencies, resale and internal use by companies, public bodies or non-profit organisations shall be deemed unlawful commercial use.

Unless expressly permitted to private clients, the User may neither copy, disassemble, translate, transmit or alter the aerial photography material or combined presentations on the website, acquire source code or the structure of the presentations or image data or, by using the image material presented, create image data from the products shown. The User shall not remove or alter any copyright notices, copyright annotations, logos or any other indication contained or depicted in the image data. Neither GeoContent nor any third party who has supplied the image material shall be liable to the User in any form, particularly with regard to the correctness, completeness and timeliness of the presented content.

The provision of the data on the internet does not represent an offer to conclude a contract with a User. The contractual use of the aerial photographic material, whether for free or for payment, is governed by GeoContent's General Terms & Conditions.
